'Wins or loses': Legal experts think judge could still jail Trump if he becomes president

Even if he wins the November 5 election, Donald Trump must appear before Judge Juan Merchan for sentencingin the New York fraud trial on November 26 — and he faces two very different scenarios.

Trump was convicted of 34 counts of falsifying business records in the hush money case brought by Manhattan District Attorney Alvin Bragg earlier this year. Prosecutors said Trump concealed records to cover up a hush payment scheme to adult film star Stormy Daniels to hide a sexual relationship from voters, improperly influencing the 2016 presidential election.

In the latest"Jack" podcast, a listener asked how the sentencing could unfold, given the recent Supreme Court's ruling that Trump has immunity for officials acts carried out while president, and in light of whatever the election result is.

Podcast hosts legal analyst Allison Gill and former FBI deputy director Andrew McCabe think Merchan will issue a sentence that is the same whatever the election result. However, the way the sentencing unfolds might be different.

"It seems like a simple question, but when you unpack it in your head, it gets a little complicated," prefaced McCabe. "One is the legal side of how do the election results affect this sentencing process. The second one is the sentencing side, like what could he get? Could he be detained, that sort of thing."

Longtime Trump critic Conway said the PAC, of which he is president, “was founded for one reason: to make the case to voters that Donald Trump is a narcissist and a sociopath.”

“If it wasn’t clear by his erratic, self-obsessed behavior, his pathological lying, his lack of moral conscience, his assaults of women, and his blatant disregard for the safety of others, more than 200 experts agree that he is unfit for office,” he added. “Voters need to recognize the threat we face electing this deranged man.”

Trump files $10 billion lawsuit against CBS News over Kamala Harris interview

Donald Trump is suing CBS News for $10 billion, alleging that the network deceptively edited an interview with his rival Kamala Harris to unlawfully influence the 2024 presidential election.

The lawsuit, filed in Texas, accuses CBS of “partisan and unlawful acts of election and voter interference through malicious, deceptive, and substantial news distortion calculated to … confuse, deceive, and mislead the public” and “attempt to tip the scales” in favor of the Democratic nominee.

His legal team filed the lawsuit in a federal court in Amarillo, where the case is expected to land in front of a judge he appointed. Any appeal of a decision in the case would go to a Louisiana-based appellate court that is dominated by conservative judges that have routinely sided in Republican-backed legal challenges.

A case from Trump — who lives in Florida, and who is suing a New York-based company incorporated in Delaware — is likely to be handed to conservative District Judge Matthew Kacsmaryk, who Trump nominated to the bench. Judge Kacsmaryk notably reinstated Trump’s so-called “remain in Mexico” program and ruled to strip government approval of a widely used abortion drug. Both decisions were struck down by the Supreme Court.
