Marvel and DC Lose Trademark for 'Super Hero'

Marvel and DC have lost their trademarks for the terms "super hero" and "super heroes" after holding onto them for decades.

As reported by Reuters, DC allegedly threated legal action and accused S.J. Richold, the author of comic series Superbabies, of infringing on its copyright. The Superbabies brand retaliated, however, saying in May that Marvel and DC can't "claim ownership over an entire genre."

The Trademark Trial and Appeal Board of the United States Patent and Trademark Office ruled in favor of Superbabies after neither Marvel owner Disney nor DC owner Warner Bros. filed an answer to the request to invalidate the trademarks.

Superbabies attorney Adam Adler of Reichman Jorgensen Lehman & Feldberg said the move was "not just a win for our client but a victory for creativity and innovation."

"By establishing super heroes' place in the public domain, we safeguard it as a symbol of heroism available to all storytellers," Adler added.

U.S. job creation totaled 254,000 in September, much better than expected

The U.S. economy added far more jobs than expected in September, pointing to a vital employment picture as the unemployment rate edged lower, the Labor Department reported Friday.

Nonfarm payrolls surged by 254,000 for the month, up from a revised 159,000 in August and better than the 150,000 Dow Jones consensus forecast. The unemployment rate fell to 4.1%, down 0.1 percentage point.



With upward revisions from previous months, the report eases concerns about the state of the labor market and likely locks in the Federal Reserve to a more gradual pace of interest rate reductions. August’s total was revised up by 17,000 while July saw a much larger addition of 55,000, taking the monthly growth up to 144,000.

Strength in job creation spilled over to wages, as average hourly earnings increased 0.4% on the month and were up 4% from a year ago. Both figures were ahead of respective estimates for gains of 0.3% and 3.8%.

Florida Gov. Ron DeSantis has issued a state of emergency in 35 counties as Tropical Storm Milton prepares to hit the Sunshine State.

The storm is intensifying over the Gulf of Mexico and is projected to become a hurricane by early Monday.

“This system could become a major hurricane near or at landfall along the West Florida Coast by the middle of next week,” said DeSantis’ executive order.

The emergency declaration applies to the following counties: Brevard, Broward, Charlotte, Citrus, Collier, DeSoto, Flagler, Glades, Hardee, Hendry, Hernando, Highlands, Hillsborough, Indian River, Lake, Lee, Manatee, Marion, Martin, Miami-Dade, Monroe, Okeechohee, Orange, Osceola, Palm Beach, Pasco, Pinellas, Polk, Putnam, Sarasota, Seminole, St. Johns, St. Lucie, Sumter, and Volusia.
