Powell files speedy trial demand

Attorney Sidney Powell on Friday filed a speedy trial demand in the Fulton County elections interference case that has also ensnared former President Donald Trump and ex-New York City Mayor Rudy Giuliani.

Powell becomes the second defendant to file for a speedy trial in the sprawling racketeering case, which culminated in a 19-person, 41-count indictment last week.

Attorney and co-defendant Kenneth Chesebro filed a similar request on Wednesday. Fulton Superior Court Judge Scott McAfee subsequently set an Oct. 23 trial date. It’s likely that Powell’s motion will now add her to those proceedings in late October..

Gov Kemp WILL NOT approve a commission to remove Fani Willis as DA.

Kemp said the following: "I have not seen any evidence that DA Willis's actions or lack thereof warrant action by the prosecuting attorney oversight commission."

He specifically addressed Senator Colton Moore's warning of a "civil war" if they don't remove Willis:

"There have been calls by one individual in the General Assembly and that got outside of these walls by the former president for a special session that would ignore current GA law and directly interfere with the proceedings of a separate but equal branch of government."

"In Georgia, we will not be engaging in political theater that only inflames the emotions of the moment. We will do what is right .. We need to be honest with people about what we're dealing with an not inciting people .. we have to be very careful when you're in power ... not to abuse that power."

Introduction:

WASHINGTON (Courthouse News) — A federal judge ruled that Rudy Giuliani forfeited his case in a defamation suit brought by two Georgia poll workers who Giuliani had falsely accused of mishandling ballots during the 2020 election in the state.

U.S. District Judge Beryl Howell wrote in a scathing opinion on Wednesday that Giuliani's refusal to comply with court orders to turn over documents had made the case's discovery process a "murky mess" and ordered the former New York City mayor to disclose financial and business records and pay plaintiffs over $100,000 to reimburse their attorney fees.

The Barack Obama appointee wrote that Giuliani's previous stipulation agreeing with the factual elements of the defamation claims while asserting that his statements were protected "hold[s] more holes than Swiss cheese."

As part of Giuliani's and other members of former President Donald Trump’s legal team made false claims about ballot fraud during the 2020 election, Giuliani directly targeted two poll workers, Ruby Freeman and Wandrea “Shaye” Moss, during a Georgia legislative subcommittee hearing in December 2020.

He falsely claimed the mother and daughter had filled suitcases with illegal ballots and brought them to the State Farm Arena in Atlanta to illegally influence the election outcome. He also made racist claims that Freeman and Moss were passing USB devices “like vials of heroin or cocaine.”

Trump dismissive as New York attorney general accuses him of inflating his net worth by $2 billion

NEW YORK (AP) — Donald Trump defended his real estate empire and his presidency in a face-to-face clash with the New York attorney general suing him for fraud, testifying at a closed-door grilling in April that his company is flush with cash — and claiming he saved “millions of lives” by deterring nuclear war when he was president.

Trump, in testimony made public Wednesday, said it was a “terrible thing” that Attorney General Letitia James was suing him over claims he made on annual financial statements about his net worth and the value of his skyscrapers, golf courses and other assets.

Trump’s lawyers released Trump’s 479-page deposition transcript in a flurry of court filings ahead of a Sept. 22 hearing where a judge could resolve part or all of the lawsuit before it goes to trial in October. James said evidence shows Trump fraudulently inflated his net worth by up to 39%, or more than $2 billion, in some years.

Sitting across from James at her Manhattan office on April 13, Trump said, “you don’t have a case and you should drop this case.” Noting his contributions to the city’s skyline, Trump said “it’s a shame” that “now I have to come and justify myself to you.”

Witness in Trump documents case reached deal with prosecutors, ex-attorney says

WASHINGTON, Sept 6 (Reuters) - A key witness in the case accusing former U.S. President Donald Trump of mishandling classified documents after leaving office has entered into a deal with prosecutors to provide testimony, his former attorney said in a Wednesday court filing.

The deal was reached after U.S. Special Counsel Jack Smith’s office threatened to prosecute the witness, who is the head of information technology at Trump's Mar-a-Lago Florida resort, for lying to a grand jury, the attorney, Stanley Woodward, said in the filing.

Woodward currently represents Walt Nauta, one of the two Trump employees also charged in the documents case, in addition to having previously represented the IT head, who is not named in Wednesday's filing.

Prosecutors have said the employee is likely to testify at trial, posing a potential conflict of interest for Woodward, who will face the prospect of a former client testifying against a current client.

Former Trump adviser Peter Navarro is convicted of contempt of Congress in Jan. 6 investigation

WASHINGTON — Former Trump White House adviser Peter Navarro was convicted Thursday of criminal contempt of Congress for failing to comply with a congressional subpoena related to the plot to overturn the 2020 election.

The jury deliberated for about four hours before finding Navarro, 74, guilty of two counts of contempt for refusing to testify before the House Jan. 6 committee and turn over subpoenaed documents.

U.S. District Judge Amit Mehta scheduled his sentencing for Jan. 12.

The two counts each carry a minimum of 30 days and a maximum of one year in prison, in addition to a maximum fine of $100,000. “There’s no mistake, no accident,” prosecutor John Crabb told jurors in the Washington, D.C. federal courtroom during closing arguments Thursday morning. “That man thinks he’s above the law,” Crabb said. “In this country, nobody is above the law."

Report Reveals Special Grand Jury Recommended 39 Indictments in Trump Election Interference Probe

Introduction:

ATLANTA (Courthouse News) — The full findings of the special purpose grand jury's investigation that led to the indictment in Georgia of former President Donald Trump and several of his affiliates was released Friday, revealing that an additional 20 people were recommended for criminal charges.

The 23-person jury's report was finalized in January, but a majority of its content was kept under seal by a Fulton County Superior Court judge, as requested by Fulton County District Attorney Fani Willis, who led the investigation.

According to the 28-page document, the jurors recommended 39 people be indicted for alleged crimes, while only 19, including Trump, were ultimately charged with racketeering and other related crimes last month.

The newly released recommendations included one of Trump's close associates, U.S. Senator Lindsey Graham; his former national security adviser, Michael Flynn; and two former Georgia Republican senators, David Perdue and Kelly Loeffler.
Graham was among the 75 witnesses summoned to testify before the special grand jury last year, after ultimately losing a challenge that went all the way to the U.S. Supreme Court to fight his subpoena.
