‘Special counsel Jack Smith has outlined new details of former President Donald Trump and his allies' sweeping and "increasingly desperate" efforts to overturn his 2020 election loss, in a blockbuster court filing Wednesday aimed at defending Smith's prosecution of Trump following the Supreme Court's July immunity ruling.
Trump intentionally lied to the public, state election officials, and his own vice president in an effort to cling to power after losing the election, while privately describing some of the claims of election fraud as "crazy," prosecutors alleged in the 165-page filing.
"When the defendant lost the 2020 presidential election, he resorted to crimes to try to stay in office," the filing said. "With private co-conspirators, the defendant launched a series of increasingly desperate plans to overturn the legitimate election results in seven states that he had lost."’

^^^No. Trump still runs the Republican party. They will follow him over a cliff before they switch to Vance at this late a stage in the campaign. The latest revelation doesn't really tell us anything we didn't already know: that Trump participated in a very sloppy coup attempt. An attempt that, despite its sloppiness, came uncomfortably close to succeeding. We already knew that, and yet Trump is in a virtual tie with Harris in the polls. Only the voters can stop Trump and maintain some semblance of sanity in Wahington D.C. Not an imploding campaign that catapults Vance.

SPRINGFIELD, Ohio (AP) — An Ohio court has referred to county prosecutors a criminal case brought by a citizens’ group against the Republican presidential and vice presidential candidates over their comments about Haitian immigrants but rejected the group’s call to issue arrest warrants or misdemeanor summons.
Springfield officials said in a statement Saturday that the Clark County municipal court found no probable cause to issue warrants or summons on misdemeanor charges against former president Donald Trump and his running mate, Ohio Sen. JD Vance. “The matter was then referred to the Clark County prosecutor’s office for further investigation,” city officials said.
The Springfield News-Sun reports that the judicial panel said particular consideration should be given to “the strong constitutional protections afforded to speech, and political speech in particular” with the election so close and the “contentious” nature of the issue of immigration.
The Haitian Bridge Alliance, a nonprofit group representing the Haitian community, last month invoked a private-citizen right to file charges over the chaos and threats experienced since Trump first spread false claims about legal immigrants there during a presidential debate.

I do think there is a valid First Amendment concern about suing politicians for the harm they may bring to individuals or groups. To me, part of the answer lays in shifting the responsibility to the media for fact-checking. At the very least, there should be a disclaimer that "(our news organization) was unable to verify the claims made by candidate Trump." First Amendment protections have always been about prior restraint by government. They have never, at least in the ideal, been about allowing libel and slander to occur without recourse on the part of the victim. It should be a news organizations responsibility to avoid slandering or libeling people mentioned in their stories. Failure to do some basic fact-checking is therefore a failure in basic journalistic ethics. One that, in some circumstances, should open up such media outlets to civil suits.
If candidates make outrageous claims that the media does not amplify through coverage, then the damage is minimized. It is the megaphone function of the media that often causes the greatest harm. It is the media that should therefore be held accountable. This still leaves the problem of voters believing candidates even as media sources advise them of the falsity of candidate claims. That is on those voters. Moreover, when such individuals participate in bullying tactics or themselves spread false rumors even as they ignore the findings of fact-checkers, then such individuals should also be potentially held responsible for libel and/or slander.
We simply cannot live in a society where a bunch of goons act outside the law to punish those fingered by the likes of Trump for whatever reasons that might exist for creating falsehoods. People, whatever their citizenship status, should be entitled to be free of that fascist nonsense.
Edit: I am having second thoughts about my post. I am not sure my proposed solution goes far enough in protecting the suing parties. We will se how the courts handle this sticky problem.
